Tips for a Successful Divorce

Divorce, even when parties to the divorce are amicable, can be emotional and complicated. While there is no doubt divorce can be tough, there are things an individual, and a couple, can do to improve the experience and achieve a successful outcome. Put a Plan in Place

Failing to have a plan in place for yourself and your life, both during and post-divorce is something that will only complicate the divorce process. Before you even start the divorce process, ask–and answer–important questions, such as:

  • Where will you live before and after the divorce?
  • Where will any children live during the divorce?
  • How will you support yourself financially before and after the divorce?
  • How will you tell friends and family about the divorce?
  • What do you want in terms of spousal support, child custody, child support, and a property division arrangement?

Answering tough questions early, means one last thing to think about later, when things may get more complicated and contentious.

Educate Yourself

Before you put together your plan for divorce and assume you’ll get everything that you want, it’s important to educate yourself about Illinois’ family and divorce laws. For example, assuming you and your spouse do not agree on child custody, property division, or/and spousal support, do you know how a court will make a determination in regards to these issues? Are you prepared to present your side to the court?

Commit to Civility

If there’s one thing you can do to improve your experience during divorce, it is to commit to being civil. Even if your spouse isn’t, your amiability can go a long way to placate your spouse, support mediation and negotiation, avoid litigation and overall keep you feeling better. Being civil–if not downright kind–is especially important if you have any children who will be impacted by the divorce. Seeing parents fight can be psychologically damaging for a child; it’s best if parents commit to working together to reach resolutions that are best for everyone, most importantly the child.

Hire a Skilled Divorce Attorney

Even if you and your spouse get along and are in agreement about how issues in your divorce should be resolved, you should absolutely commit to hiring a skilled divorce lawyer from the onset of the divorce process. At the very least, your attorney can review all of your divorce agreements to ensure they are both just and legally sound.
